Bela Megale’s column in *O Globo* (July 29, 2026) reveals that Supreme Court (STF) justices are already signaling intervention should the Superior Electoral Court (TSE) fail to penalize an AI-generated video of Jair Bolsonaro shown at Flávio Bolsonaro’s convention. They label it a “deepfake” and fear a “free-for-all” scenario. But what is at stake goes far beyond a single video: 1⃣ Violation of the personal nature of penalties — Single-judge and collegiate rulings extend restrictions and punitive effects to third parties (campaign staff, political parties, supporters, and family members) for acts the convicted individual did not personally commit. This violates Article 5, XLV, of the Brazilian Constitution and the universal principle that “no penalty shall extend beyond the person of the convicted” (International Covenant on Civil and Political Rights – ICCPR, Art. 15; American Convention on Human Rights – ACHR, Arts. 5 and 8; Inter-American Court jurisprudence). 2⃣ Destruction of due process and the right to a lawful judge — Justice Luiz Fux’s vote during the trial of the criminal case against Bolsonaro exposed a lack of sufficient evidence (Art. 386, VII, Code of Criminal Procedure), a generic indictment, liability for the acts of third parties without a causal link, and the selective shifting of the STF’s jurisdiction. The Court acts as both judge and party, concentrating power and creating case-specific precedents. 3⃣ Lawfare and censorship — The law is being used as a political weapon: prior restraints on political content, threats to revoke a ticket’s eligibility due to AI usage, and signals that the STF will “step in” if the TSE fails to impose penalties. Furthermore, it must be made clear: the censorship imposed on Jair Bolsonaro and the restrictions on communication and visits with his children are illegal under Brazilian law and international law. In Brazil, the Federal Constitution (Art. 5, IV, IX, and XLV) prohibits prior restraint, guarantees freedom of expression, and establishes that no penalty shall extend beyond the person of the convicted individual. Broad restrictions that prevent the use of social media—including by third parties—and turn any indirect expression into grounds for imprisonment constitute prior restraint, a practice banned since 1988 and reaffirmed by the Supreme Federal Court’s (STF) own jurisprudence (ADPF 130). The suspension of visits by his children (such as the 90-day ban imposed on Flávio Bolsonaro) borders on *incomunicabilidade* (total isolation/denial of communication), a measure deemed unconstitutional under the Brazilian legal order since 1988. Detainees have the right to family contact (Art. 5, LXIII, CF). Restrictions must be proportionate and justified by a concrete risk—not used as an additional sanction or a tool for political silencing. At the international level, these measures violate: ➡️ ACHR (American Convention on Human Rights): Arts. 8 and 13 (judicial guarantees, the right to communicate with family members, and the prohibition of prior restraint); ➡️ ICCPR (International Covenant on Civil and Political Rights): Arts. 10 and 19 (humane treatment of persons deprived of liberty and freedom of expression); ➡️ Jurisprudence of the Inter-American Court of Human Rights, which repeatedly condemns arbitrary restrictions on family communication and the use of the legal system as an instrument of political persecution (*lawfare*). Fundamental guarantees, human rights, and due process are being trampled upon. What is happening in Brazil is not an electoral dispute; it is the normalization of the selective use of the judicial apparatus to persecute, isolate, and silence. We call for the urgent attention of the Inter-American Commission on Human Rights, the UN Human Rights Council, democratic parliaments, and the international legal community. The world needs to pay attention.
