Fauci refused to answer questions about C*VID-19 origins, gain-of-function research funding, prior testimony, fatality rate, lockdown measures and more - invoking the Fifth Amendment 111 times. #Congress The four mistakes that could come back to haunt Fauci, according to Aaron Siri - the Managing Partner of Siri & Glimstad LLP. 🟧He talked about his past testimony first, then tried to shut down more questions on the same topics by pleading the 5th. ➡️Once a witness brings up a topic on his own, he cannot later refuse to talk about it. ➡️Courts call this “opening the door.” The same problem came up years ago with Lois Lerner at the IRS. ➡️Fauci’s own words about his past cooperation made those subjects fair game. ➡️In his opening remarks, Fauci bragged about his 54 years at the NIH, including 38 as NIAID director. ➡️ He said he had testified or briefed Congress more than 200 times and had answered questions under oath multiple times during and after C*VID on the exact issues being discussed. ➡️After saying all that, he attacked Sen. Rand Paul and announced he would not answer any more questions. 🟧He refused to answer simple questions that could not get him in legal trouble. ➡️The Fifth Amendment only protects answers that could actually help prosecute someone for a crime. ➡️It is not a free pass to ignore every question. ➡️Sen. Josh Hawley asked basic things like what day of the week it was, what color tie Fauci was wearing, and what color the carpet was. ➡️Fauci gave the same refusal every time. ➡️Republicans said this proved he was not truly worried about incrimination and was just showing contempt for the committee. ➡️The law does not allow the Fifth when the answer clearly cannot hurt the witness. 🟧He announced he would refuse all questions before anyone even asked one. ➡️The Fifth Amendment works question by question. ➡️A witness must hear the specific question and then decide if answering it creates real legal risk. ➡️Fauci declared in his opening statement that he would not answer the committee’s questions at all. ➡️He then repeated the same scripted line for every question that followed. ➡️That is not how the right works. It is not a general “I quit” button for the whole hearing and can be seen as blocking / obstructing the investigation. 🟧He ignored the full pardon he already received from Joe Biden. ➡️On January 19, 2025, Biden gave Fauci a full pardon covering any federal offenses tied to his government work from January 1, 2014, through the date of the pardon. ➡️That includes his time as NIAID director and COVID adviser. ➡️Republicans, including Paul and Hawley, pointed out that once you are pardoned for something, you cannot claim the Fifth to avoid talking about it. ➡️An old Supreme Court case, Brown v.
