Authorities took photos and tried to push contempt charges saying the tent counted as an indoor space. They also accused the church of failing to make sure every attendee was v*ccinated. On Feb. 2, 2023, Chief Justice Tracey DeWare dismissed the contempt allegations ruling that she could not determine beyond a reasonable doubt that the tent “clearly and unequivocally” met the definition of an enclosed or public indoor space. Earlier public health tickets and obstruction charges had already been withdrawn by prosecutors in late 2022 after a constitutional challenge.
