SB‑120: State Senator Tracy Pennycuick Voices Her Opinion on Marijuana Legalization I contacted our State Senator Tracy Pennycuick stating my opposition to SB-120, the marijuana legalization legislation. As you can see from this quote from her response, she is in opposition to the legislation. “Marijuana remains illegal at the federal level, meaning that a state-store lead retail operation opens the state and our treasury to significant financial liabilities, federal sanctions, and banking prohibitions, which are all risks not present in other available models for legalization. Until these financial issues are rectified by federal action, a state lead dispensary option subjects the commonwealth to far too great of financial risk.” “Additionally, I am still concerned with testing. Currently, there is no test that can give an immediate result, like the breathalyzer, to determine if someone is under the influence. Even further, there is currently no legal definition of what “under the influence” is in state statute and remains a gray area. This remains a top concern of the business community, and these questions need to be rectified before we legalize cannabis, outside of medicinal use, in our state.” While the Senator's reasons for her opposition are different from my health-related concerns, we are in lockstep in our opposition.
