Why is it that the damages from id theft are the responsibility of the victim of id theft unless they prove they are a victim? After all, it isn't the victim that approved a loan granted under false pretenses, it is the organization that approved the loan... Seems to me that would be THEIR "ball drop", not the victims who did not even know they were being victimized. "Because the loan agencies don't know the applicant is lying." & clearly their efforts to know are far inadequate... i have had the same phone number for damn near 15 years & i still get texts & calls from collections agencies, because people take out loans for which they provided fraudulent phone numbers for, seems to me that if someone was asking me for a loan, the first thing i would do is CALL the gd phone number they give me to make sure it is actually their phone number or at least associated with them. These texts should come with a second option after "reply stop" that is something like "reply 'not me' to confirm you did not take out this loan." "but then anybody could take out a loan & say they didn't." That is why CALLING the phone number provided while the person who provided it is sitting right freaking there would be prudent. The policy should not be "approve the loan based on face value of information provided & if that information is fraudulent, we will just collect from the person whose info they stole or the insurance agency or the agency protecting that person's info or anybody but themselves who erroneously approved the loan. The loan company has the resources, the funds, the government support... Essentially, the ability to avoid approving fraudulent loans, AND the ability to afford the loss when they do, the victims don't. The policy should be "don't approve the loan until the info provided is absolutely verified or the loan agency takes the loss when it turns out to be fraudulent." The fact that i got a random text from a collection's agency trying to collect on a Walmart awards card means the folks at the Walmart awards card approval facility are bad at their job & only Walmart should take the loss because the folks at the Walmart awards card approval facility could have simply called MY number when they saw it on an application & said is this so & so's phone number, I would have said no & they could have said gtfo to the applicant. Fortunately, for me i am sure it is not a case of id theft but simply a random number pulled out of the applicant's ass because it happens all the time, to both my cell number & land line, yet there is never any further follow up meaning a mf'r can walk into a loan office & put down any random number as a phone number because the loan agency is so wanting to give loans out they don't even call the phone numbers that applicants provide to be sure it is legit because they know they are not held responsible for approving fraudulent apps, the victims whose info the applicant has stolen are, as far as they are concerned, they get paid either way. Change that, make it so the loan agencies take the loss & i have no doubt that fraudulent loans taken out under stolen information would damn near cease all together... & ID protection companies will no longer be able to capitalize on victimization. It is like the "house theft" thing, i have no doubt in my mind that if responsibility for the loss as a result of house theft was put on the recorder's office instead of the victims, house theft would suddenly not be so easy to do... & the folks capitalizing on that form of victimization would no longer be able to capitalize on it & we would no longer see commercials saying "pay us to keep your house from being stolen because the government who job it is to keep the people from being victimized is not going to do anything to prevent it..." Hell, they are far too busy with their own victimization of the people they "serve" with no risk of retribution. I have lived in this house for 15years, if a random person walked into the recorder's office & said they own my house with very little evidence to support that claim, the recorder's office will simply say "ok", when they could, instead, look at the name of the person in front of them, look at the name of the residents of the property & see they are not one in the same & say "we are going to have to look further into this", simply contact the residents living at the property & ask them for the deed, I know I sure as hell can prove my house is mine... except, apparently, that is somehow illegal... Why is it illegal to verify a claim of ownership for anything, especially a freaking house? CHANGE THAT ffs. Nothing against the folks at "home title lock" but such a business should not even exist as the service they provide, the government could just as easily provide for free & THAT is what the government is supposed to be for. Victimization should never be capitalized on, if victimization is capitalized on, the government has failed the people. Just sayin'.
