In my lawsuit vs. govt for computer intrusions: The law gives DOJ (guilty party) power to grant or deny our to access to crucial docs/witnesses it exclusively controls (needed to produce specific names required, etc). So DOJ stalls, denies permission, then asks court to dismiss case for lack of evidence. The law should obviously be changed --or citizens have no recourse for govt's obviously illegal action. However, Congress won't change law because no powerful interest is lobbying, paying members, and writing a new proposal-- and that's pretty much the main way a law gets changed or considered today.
