ITALY, July 23, 2026: Bill Making Young People Liable for Their Crimes The burden of proof regarding incapacity to discern the seriousness of a crime would be reversed, without, however, altering the minimum age of criminal responsibility or the penalties provided for under the Penal Code. On July 23, 2026, the Italian Council of Ministers introduced a bill aimed at rendering young persons more accountable for their crimes. What wouldn't change? -> The penalties already set forth in the Penal Code would not be increased, -> and the age of criminal responsibility (the age of discernment under the Penal Code) would remain at 14 years and older. What would change? The burden of proof of incapacity to discern the seriousness of a crime for a young person between the ages of 14 and 18 would be reversed. It would now fall to the defense to demonstrate that a young person lacked the capacity to understand the seriousness of his or her acts. This measure seeks to hold young persons accountable and to cease exposing them to criminals who exploit the latitude afforded by the law.
