Missouri AG Catherine Hanaway sued the ATF to end federal registration of suppressors and short-barreled rifles and shotguns. Her complaint: Congress zeroed the NFA tax on those items, so the old tax-based registry no longer has a constitutional footing. ATF still requires paperwork and data collection, with criminal penalties attached. Hanaway: a government that respects the Constitution “does not paper over rights with red tape.” A Texas federal court reached a similar conclusion on Aug. 5.
