The full Fifth Circuit, 10–5, affirmed dismissal of Jackson residents’ §1983 suit over lead in city water. Judge Engelhardt: “The Constitution does not provide redress for every governmental wrongdoing.” And: “It is undisputed that the Constitution does not guarantee clean water.” The court also found no constitutional right to “truthful information” from officials in a public-health crisis. Statutes, torts, and the Safe Drinking Water Act still apply. The ruling conflicts with the Sixth Circuit’s Flint cases. Some state constitutions list clean water.
