What's a Monell Claim? A Monell claim comes from the U.S. Supreme Court case Monel/ v. Department of Social Services (1978). It allows someone to sue a city, county, or other local government under 42 U.S.C. § 1983 when their constitutional rights are violated because of an official policy or custom.
