Viewpoint Discrimination

Viewpoint discrimination is the practice of applying different rules to speech based on the ideological or political position it expresses — punishing one side of a debate while permitting the other. In First Amendment law, viewpoint discrimination by government is one of the most serious constitutional violations. As a criticism of Big Tech platforms, it is the central accusation: that moderation enforces conservative-speech rules that don't apply to liberal speech.

What it means

Classic examples: a public university that allows pro-choice campus groups but bans pro-life ones. A city that permits protests supporting one political candidate but bans protests opposing them. Both are textbook viewpoint discrimination — the rules change based on the message, not the conduct.

Applied to social platforms: suspending accounts that criticize COVID-19 vaccine mandates while permitting accounts that demand them; removing content that challenges mainstream climate reporting while hosting content that attacks dissenters. If the enforcement pattern lines up with a political viewpoint rather than an objective rule, it's viewpoint discrimination.
